These Terms of Service set out the terms and conditions applying to access to and use of the website dawnmeta.vn, the Dawn Meta platform and the services provided through the platform by CÔNG TY TNHH APETA (“the Company”, “we”, “us”, “our”).
Dawn Meta provides tools that help customers manage, consolidate, display and monitor information relating to the advertising assets they are entitled to manage or use on Meta's platforms, including Facebook, through the integration methods and access permissions Meta allows.
Your access to or use of the Service means you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not continue to access or use the Service.
1. Interpretation and definitions
1.1. Interpretation
Words whose initial letter is capitalised have the meanings set out below. These definitions have the same meaning whether they appear in the singular or the plural.
1.2. Definitions
For the purposes of these Terms of Service:
Company (referred to as “the Company”, “We”, “Us” or “Our” in these Terms) is:

Dawn Meta is the platform operated by the Company at dawnmeta.vn.
Account means the account created for or granted to you to access the Service or parts of the Service.
Meta Account means an account, business asset or advertising asset within the Meta ecosystem that the user is legally entitled to access, manage, or allow the Service to connect to.
BM in these Terms refers to the corresponding business management asset provided within the Meta ecosystem.
Ad account means an advertising account managed or used through the Meta ecosystem.
Meta Data means data provided by or retrieved from Meta's products, APIs, interfaces or services within the scope of access granted and permitted for use.
Service comprises the Dawn Meta website and the management, display, statistics, operational support and related functions provided through the platform.
Meta refers to Meta Platforms, Inc. and/or its relevant affiliates operating products and services such as Facebook.
You means the individual accessing or using the Service, or the organisation that individual represents.
2. Acceptance of these Terms
Access to and use of the Service is conditional on accepting and complying with these Terms.
By accessing or using Dawn Meta, you agree to be bound by these Terms, the Privacy Policy and the other rules applying to the Service.
If you use the Service on behalf of a business or organisation, you confirm that you have the authority to represent it or have been duly authorised to make the connection and use the corresponding assets, data and functions.
You must not use Dawn Meta to access assets, data or accounts that you have no lawful right to access.
3. Scope of the Dawn Meta Service
Dawn Meta is a platform supporting the management and operation of advertising resources for customers and authorised users.
Depending on your Account's permissions, the state of the integration and the capabilities Meta makes available, the Service may support:
- Connecting to resources and services within the Meta ecosystem;
- Reading and synchronising data the user is entitled to access;
- Displaying information relating to BMs;
- Displaying information relating to ad accounts;
- Consolidating the advertising assets under the user's management;
- Displaying the status of and information about advertising accounts;
- Consolidating and compiling statistics for management purposes;
- Displaying figures relating to advertising activity within the scope of the data authorised;
- Supporting the management of advertising resources;
- Supporting requests relating to funding and limit increases through the functions provided;
- Providing other related management and operational support tools.
Dawn Meta processes resources and data only to the extent necessary to provide the corresponding functions and within the scope of valid access permissions.
4. Connecting with Meta and Facebook
Some Dawn Meta functions depend on connecting to platforms, services or resources provided by Meta.
When using this function, the user must hold lawful rights over the Meta account or asset being connected.
Connecting does not transfer ownership of a Meta Account, BM, ad account or other asset to Dawn Meta.
Dawn Meta acts solely as a tooling layer supporting the management and operation of resources the user is entitled to use.
Use of Meta's APIs or access mechanisms must comply with the scope of permissions granted, Meta's Terms, and the requirements applying to integrated applications or services.
Dawn Meta must not be construed as granting users access to data or resources that Meta does not permit the user or application to access.
5. Access rights and authorisation
When connecting a Meta resource to Dawn Meta, you confirm that:
- You are the party entitled to access that resource, or have been permitted to do so by the party with authority;
- You have the right to allow Dawn Meta to access the data needed to provide the Service;
- Your scope of use does not exceed the permissions granted by Meta or by the resource owner;
- The information and access permissions provided are lawful;
- You are not using another person's Account without permission.
Dawn Meta may use the access granted only to provide the corresponding functions of the Service.
Granting access to Dawn Meta does not amount to transferring ownership of a Meta account or asset.
6. Use of data from Meta
Within the scope permitted by the user and permitted by Meta, Dawn Meta may access, receive, process, synchronise and display the Meta Data needed to provide the Service.
Data may be used to:
- Identify the resources under the user's management;
- Display the list of BMs;
- Display the list of ad accounts;
- Display account information and status;
- Synchronise data between Meta and Dawn Meta;
- Consolidate data for management purposes;
- Display reports and statistics;
- Support functions for managing advertising resources;
- Carry out the functions the user actively requests through the Service.
Dawn Meta must not use Meta Data for purposes unrelated to providing the Service where such use is not permitted.
Data received from Meta gives rise to no ownership by Dawn Meta over the user's account or assets.
7. Principles for using Meta data
Dawn Meta applies the principle of purpose limitation to data accessed from Meta.
Data is processed only to the extent necessary for the function the user is using, or for activity necessary to operate, secure and maintain the Service.
Dawn Meta does not deliberately use the access granted in order to:
- Access data beyond the scope of the permissions granted;
- Circumvent Meta's access control mechanisms;
- Gain unauthorised access to Meta accounts or resources;
- Collect data not needed for the Service's functions;
- Sell user data received from Meta;
- Use data to impersonate a user;
- Carry out fraud or otherwise affect the integrity of the Meta ecosystem.
Data processing must be consistent with Dawn Meta's Privacy Policy, these Terms, and the applicable requirements of the source platform.
8. Displaying BMs and ad accounts
Dawn Meta may provide a single interface for users to view and manage the BM and ad account information they are entitled to access.
Information shown on Dawn Meta may be drawn from data provided through Meta, data supplied by the customer, or data processed by the system while providing the Service.
Dawn Meta may reorganise data as lists, tables, statuses, filters, statistics, reports or management interfaces to make resource management easier for the user.
Dawn Meta displaying a BM or an ad account does not change ownership of or control over that asset on Meta's systems.
Actual access to Meta assets continues to depend on the status and permissions determined on the Meta platform.
9. Reports and statistics
Dawn Meta may process the data it is permitted to access in order to produce reports, statistics and consolidated views for management purposes.
Reports and statistics may be formed from data provided by Meta, data supplied by the user, or data generated while using the Service.
Dawn Meta may present data at the management levels appropriate to the Account's permissions.
Figures synchronised from a third-party platform may depend on the time of synchronisation, data latency, API status, or how the source platform updates its data.
Information shown on Dawn Meta does not replace the official data recorded by Meta on Meta's systems where the two differ.
10. Funding and limit increases
Dawn Meta may provide a function allowing users to submit and manage requests to add funds, top up budget, or raise limits for eligible advertising resources.
The user must provide accurate information when making a request.
Submitting a request through Dawn Meta must not be construed as Dawn Meta being able to unilaterally change the limits, permissions or control mechanisms set by Meta.
Operations relating to an advertising account depend on the account's valid permissions, the state of the resource, the applicable conditions, and the corresponding technical capability.
Dawn Meta does not undertake that every request for a limit increase or other change to an advertising resource will be approved by Meta.
Users must not use the funding or limit-increase function to:
- Evade limits applied by Meta;
- Circumvent risk-control measures;
- Carry out fraudulent transactions;
- Use funds of unlawful origin;
- Run advertising activity prohibited by law or by platform policy.
11. User accounts
When creating or using a Dawn Meta Account, you are responsible for providing accurate, complete and up-to-date information to the extent required.
You are responsible for protecting your password, authentication details and access to the Account.
You must not share your Account or your access with anyone who is not authorised.
If you detect unusual activity or unauthorised access, you must notify the Company within a reasonable time.
The Company may take verification, restriction or protective measures on an Account where it detects indications that the safety of the Service may be affected.
12. Right to use the Service
Under these Terms, the Company grants you a limited, non-exclusive, non-transferable and revocable right to use Dawn Meta for lawful purposes.
This right transfers no ownership of the Company's software, systems, data, brands or intellectual property.
You may use the Service only in accordance with the functions provided, the permissions granted, and applicable law.
13. Prohibited conduct
You must not use Dawn Meta to:
- Gain unauthorised access to Facebook accounts or Meta assets;
- Use another person's authentication details without permission;
- Take over, or attempt to take over, an account;
- Circumvent Meta's permission-granting mechanisms;
- Evade security measures or access controls;
- Collect data beyond the permitted scope;
- Use collected data for unlawful purposes;
- Sell or unlawfully transfer user data;
- Impersonate a user, a business or an asset owner;
- Interfere with Meta's or Dawn Meta's systems;
- Generate traffic or automated requests that cause overload;
- Engage in spam, fraud or abuse;
- Use the Service to evade Meta's restrictions or enforcement measures;
- Use advertising resources for prohibited activity;
- Use the Service to infringe another person's privacy or intellectual property rights;
- Engage in any conduct that breaches the law or the applicable terms of a third-party platform.
14. No circumvention of Meta's mechanisms
Dawn Meta must not be used as a tool to evade or defeat Meta's control measures.
Users must not use the Service to:
- Unlawfully restore access that Meta has revoked;
- Circumvent account limits;
- Conceal identity in order to avoid enforcement measures;
- Circumvent verification requirements;
- Circumvent restrictions on an advertising account;
- Create or use resources in order to evade a Meta enforcement decision.
If Meta restricts, disables or revokes access to an account or asset, Dawn Meta gives no assurance about it and must not be used to defeat that decision.
15. Data accuracy and synchronisation
Dawn Meta endeavours to display synchronised data accurately.
However, data from Meta or third-party services may change over time, and latency may exist between the source data and what Dawn Meta displays.
The user understands that figures relating to advertising spend, account status, limits or other dynamic information may have changed since the most recent synchronisation.
Where the official status of a Meta resource must be determined, the data recorded directly on the Meta platform takes precedence.
16. Privacy and personal data
The collection, use, storage, protection and processing of personal data in connection with Dawn Meta is carried out under the Company's Privacy Policy.
Dawn Meta processes personal data only to the extent necessary, on an appropriate basis, and within the permissions granted.
Users must ensure that providing another person's data to Dawn Meta is done lawfully.
Data received through the connection with Meta is also subject to Meta's corresponding use restrictions and to the scope of the permissions the user granted.
17. Withdrawal of access
Users may stop using the Service or withdraw the access they granted, through the corresponding mechanisms provided.
When Meta access is withdrawn or expires, Dawn Meta may no longer be able to synchronise or update the corresponding data.
Dawn Meta must not continue to carry out operations requiring Meta access once the necessary permission is no longer valid.
Retention or deletion of data received beforehand is carried out under the Privacy Policy, legal obligations, and the requirements applying to the source data.
18. Third-party services
Dawn Meta may interact with third-party platforms or services.
Use of a third-party service may be governed at the same time by that third party's terms and policies.
Users are responsible for complying with the applicable terms when using a third-party account or service through Dawn Meta.
The Company does not control the independent operations, policies or decisions of third-party platforms.
19. Relationship with Meta
Dawn Meta is a service operated by CÔNG TY TNHH APETA.
Dawn Meta supporting connections to, or processing data from, Meta does not mean Dawn Meta owns Facebook, Meta or any Meta product.
Unless otherwise officially confirmed, technical integration with Meta must not be construed as Meta sponsoring, endorsing or confirming Dawn Meta as a representative of Meta.
The names Meta, Facebook, Business Manager and the related marks, products or services belong to their respective owners.
20. Changes to Meta's APIs and platform
Some Dawn Meta functions depend on APIs, access permissions, resources and systems controlled by Meta.
Meta may change its APIs, permissions, limits, data structures or access capabilities.
Accordingly, some Dawn Meta functions may need to be changed, suspended or discontinued to match changes on the source platform.
The Company does not guarantee that a function depending on a third-party platform will always remain available in the same form.
21. Service availability
The Company endeavours to keep Dawn Meta operating stably but does not guarantee that the Service will always be available or entirely free of errors.
The Service may be temporarily unavailable because of maintenance, updates, technical incidents, API changes, network faults, third-party platform incidents, or events beyond the Company's reasonable control.
22. Intellectual property
Dawn Meta and the components of the Service, including the software, interface, design, source code, text, graphics, icons and other intellectual property, belong to the Company or its respective licensors.
These Terms transfer to the user no intellectual property right of the Company or of Meta.
Data, brands and assets belonging to Meta remain the property of Meta or of the respective rights holder.
23. Suspension or termination of an Account
The Company may suspend, restrict or terminate access to Dawn Meta where it has reasonable grounds to consider that:
- The user is in breach of these Terms;
- The Account is being used for unlawful activity;
- There is abuse of data or of Meta access;
- There are attempts to evade Meta's security mechanisms or restrictions;
- There are indications of access to unauthorised resources;
- The Account's activity endangers the Service or other users;
- Suspension is necessary to comply with the law or with a requirement of the platform supplying the data.
Where Meta access expires or is withdrawn, the functions depending on that access may stop working automatically.
24. Termination by the user
You may stop using Dawn Meta at any time.
Where the Service provides a function to close or delete an Account, you may use that function or contact the Company.
Ending your use does not extinguish obligations that arose before termination.
Data handling after termination is carried out under the Privacy Policy and applicable law.
25. Disclaimer of warranties
To the maximum extent permitted by law, Dawn Meta is provided on an “as is” and “as available” basis.
The Company does not warrant that:
- The Service will always operate without interruption;
- Third-party APIs or services will always be available;
- Meta will maintain any particular permission, API or function;
- All synchronised data will be updated in real time;
- Every request relating to an advertising account will be approved by Meta;
- A user's account or assets will not be restricted by Meta under Meta's policies or systems.
Nothing in these Terms excludes rights that the law does not permit to be excluded.
26. Limitation of liability
To the extent permitted by law, the Company is not liable for damage arising from:
- The user using resources they have no right to;
- The user breaching Meta's policies;
- A decision by Meta to restrict or disable an account;
- Meta changing its APIs or access permissions;
- Source data being delayed or changed;
- The conduct of third parties beyond the Company's reasonable control;
- The user failing to protect their login details or access.
No provision excludes or limits liability where the law does not permit it.
27. Indemnity
To the extent permitted by law, the user is responsible for damage or claims arising directly from:
- Unlawful use of Dawn Meta;
- Connecting resources without permission;
- Infringing the rights of a third party;
- Breaching these Terms;
- Abusing data or access permissions;
- Providing false or fraudulent information.
28. Force majeure
The Company is not liable for delay or failure to perform an obligation caused by events beyond its reasonable control, including natural disaster, fire, war, epidemic, Internet outage, power failure, large-scale cyber attack, mandatory changes by a third-party platform, or a decision of a state authority.
29. Compliance with law and platform policies
Users must use Dawn Meta in accordance with:
- Applicable Vietnamese law;
- These Terms of Service;
- Dawn Meta's Privacy Policy;
- Meta's applicable terms and policies when using Meta resources;
- Any other legal requirements applying to the user's activity.
Dawn Meta providing a technical function must not be construed as permitting the user to carry out conduct prohibited by law or by the source platform.
30. Changes to these Terms of Service
The Company may amend or update these Terms from time to time.
When the Terms are updated, the “Last updated” date at the top of the document may be changed accordingly.
Where a change materially affects users' rights or obligations, the Company may give appropriate notice through the Service or by suitable means of communication.
Continuing to use the Service after new Terms take effect means the user accepts the updated Terms, to the extent the law permits.
31. Severability
If any provision is held invalid or unenforceable, that provision will apply to the maximum extent the law permits.
The remaining provisions stay in force.
32. Entire agreement
These Terms, together with the Privacy Policy and the policies expressly applied to Dawn Meta, constitute the agreement between the user and the Company in relation to use of the Service.
Where a separate written agreement applies to a particular service, that separate agreement governs the matters within its scope.
33. Governing law
These Terms of Service are governed by and construed in accordance with the law of the Socialist Republic of Vietnam.
The processing of personal data in connection with the Service must comply with applicable Vietnamese law on personal data protection.
34. Dispute resolution
If a dispute arises in connection with Dawn Meta or these Terms, the parties are encouraged first to discuss the matter and seek a suitable solution.
If the dispute cannot be settled by negotiation, it will be resolved under the procedures laid down by Vietnamese law.
